Terms and conditions for group coaching, training and online courses

 

 

Nico Curia legal notices and terms & conditions

 

The following constitute the terms and conditions to which applicants agree when booking any NC face-to-face, training, online training or e-learning courses (Terms and Conditions). Throughout the Terms and Conditions, the NC means NC (Administration) Nico Curia. The NC reserves the right to review and update these periodically.

 

Registration and Booking

 

1. Registration with the NC (creating an account)

Before you book onto a face-to-face training course or e-learning course we require you to register to create an account and provide certain information about yourself. In doing this, you agree to:

  • Provide true, accurate, current and complete information about yourself as prompted by the relevant registration form.

  • Maintain and promptly update the data we hold by logging into your account and updating via ‘My profile’.

 

2. Booking a face-to-face training, group coaching, workshop, seminar, online training or e-learning course

Face-to-face training, group coaching and e-learning courses can be booked via the booking forms available on the NC website. You need to be registered with the NC before you can do this as you will be required to log in or create your account to complete the form.

When you submit a booking for an online course, your submission represents an offer to the NC to book you onto the course you selected. On submission of the face-to-face training course or e-learning course form you will receive an automated summary email of your selection.

The NC will accept your offer by entering your booking onto the NC system and sending you an email confirming that you have been booked together with information on starting your learning.

 

3. Prices, discounts and sales taxes/VAT

Notice of new pricing will be given in advance, but the NC reserves the right to change prices listed without notice.

Early bird discounts (15% off the course fee) are available on face-to-face training courses. The early bird discount applies to NC courses only. The discount is not available in conjunction with any other offer and places are subject to availability.

 

4. Payment

Fees must be paid at the point of booking via NC Paypal secure online payment process. If you have an applicable discount code this must be entered at the time of booking, as the discount cannot be applied retrospectively.

All major credit and debit cards are accepted. A receipt will be sent to you by email from online payment system confirming payment. The online payment system will receive the information needed to verify and authorise your payment card and to process your order and is under strict legal and contractual obligations not to disclose this information to third parties.

Please note that if you do not provide accurate details (including type of card and number) or if your credit card company does not authorise payment, your application will be deemed void. The NC will not accept any liability for costs incurred as a result of applications deemed void in this manner.

 

Sales taxes (VAT) are charged at the applicable rate depending on the product and/or customer.

 

5. Prevailing terms and conditions

Please note that this and all other NC pre-contractual documentation shall not constitute an offer. All services provided by NC are on the basis of these Terms and Conditions and if you wish to engage any NC services NC shall only provide them if you accept the Terms and Conditions. If you offer to engage NC on your own terms and conditions then we shall only accept your offer subject to the Terms and Conditions, which shall, if we provide the services you offer to engage, prevail over any other terms and conditions.

 

2. Learning

 

1. NC group coaching, face-to-face, training courses

After booking onto a group coaching, face-to-face training course you will be given access to the NC’s the members area from the date your booking is processed until 14 days after your training course is complete. By using the members area you agree to these Terms and Conditions, if you do not agree to these terms, you cannot use the site.

Whilst we make every effort to keep changes to the site to a minimum, we reserve the right to make any amendments to the terms and conditions at any time to reflect changes affecting our business, including but not limited to, changes in technology, payment methods and legal and regulatory requirements. By continuing to use this site you agree to accept any changes made to the terms and conditions.

 

1.1 Ownership and intellectual property rights

All members area materials, whether on the NC website or at a Learning Academy training day, are owned by the NC. All intellectual property rights in all materials available from the members area, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by the NC. No members area content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without the NC’s prior permission. Any such use is strictly prohibited and will constitute an infringement of the NC’s intellectual property rights.

 

1.2 Special requirements at the group coaching, face-to-face or training course

The NC will make every effort to accommodate special requirements that have been notified in advance on the booking form.

 

1.3 Health and safety at the face-to-face training course

You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided.

 

1.4 Invitation letters

Should a participant require an invitation letter from the NC, we are able to provide this as long as full payment of the training course fee has been received. The NC is not able to NC on behalf of the participant and is not responsible for any costs incurred by failure to obtain a full visa.

 

1.5 Behaviour

The NC reserves the right to remove any delegate from a training course whose behaviour is deemed inappropriate by the NC or its trainers. In these circumstances, the NC will neither refund any fees nor reimburse any other costs.

 

1.6 Trainers 

The NC shall provide such trainers to present the training course as it, in its sole discretion, deems fit and the NC shall be entitled at any time to substitute any trainer with any other person who, in the NC’s sole discretion, it deems suitably qualified to present the relevant course.

 

1.7 Liability

The NC does not accept responsibility for anyone acting as a result of information in, or views expressed on, its training courses including course materials. Opinions expressed are those of individual trainers and not necessarily those of the NC. Participants should take professional advice when dealing with specific situations.

 

2. NC Learning Academy e-learning courses

After booking onto an e-learning course you will be given access to the NC’s members area on the terms of the licence referred to below for a period of 90 days when purchasing an individual unit, and 365 days when purchasing the annual licence. By using the Learning Academy you agree to these Terms and Conditions. If you do not agree to these terms, you cannot use the site.

By continuing to use this site you agree to accept any changes made to the terms and conditions.

 

2.1 Ownership and intellectual property rights

When you are given access to the members area, you are granted a non-exclusive, non-transferable, revocable licence to use the members area materials. No members area content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without the NC’s prior permission and you may not allow anyone else to access the members area via your log-in details. Any such use is strictly prohibited and will constitute an infringement of the NC’s intellectual property rights.

 

2.2 Technology

The NC does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.

 

2.3 Liability

The NC does not accept responsibility for anyone acting as a result of information in, or views expressed on, its training courses, including course materials. Opinions expressed are those of individual trainers and not necessarily those of the NC. Participants should take professional advice when dealing with specific situations.

 

3. Cancellation


3.1 Cancellation of a group coaching, face-to-to face or training course

If you notify the NC in writing (by email or post) that you wish to cancel a group coaching, face-to-face or training course not less than 28 days before the start date of a course, you will be entitled to a 100% refund. Refunds will be processed with 28 days of receiving your request via bank transfer to the original payer.

If you withdraw for any reason less than 28 days before the start date of a course, no refund will be issued but you may transfer your place on the course to a substitute. Substitutions should be notified to the NC at least 48 hours prior to the course start date. If you fail to attend the course on which you are booked without giving prior notice to the NC, we are unable to refund the fees or offer a transfer.

 

3.2 Transferring your place on a face-to-face or training course

There is no charge for transferring your booking to the same course on an alternative date provided you notify the NC in writing not less than 28 days before the start and if there is availability. However, a transfer fee of 20% of the course fee (plus VAT) will be payable if the notice is received less than 28 days before the start of the original course. If you transfer your booking you will not receive any refund, and you will not be entitled to transfer more than once. You must make any request to transfer a course in writing, which may be sent by email to: ncuria@gmail.com

 

3.3 Cancellation of an e-learning course

Once you have booked an e-learning course or package the fee is non-refundable and the booking non-transferrable. If you cancel any e-learning course or package you will not be entitled to any refund, nor will you be able to transfer your place either to another person or onto another e-learning course.
